Europe’s highest court rules the Internet auction site eBay may be liable for trademark infringement committed by users on its site.
That’s if it engages in an active role in their use. The decision comes in response to allegations against eBay brought by French cosmetics company L’Oreal. The high court says national courts must order online retailers to take steps that help to end trademark infringements by users of a marketplace such as eBay and prevent future infringements.
